>> at eleven. thousands of people gather in san francisco tonight to rally their support for same sex marriage. on the eve of hearings before the u.s. supreme court on proposition eight. >> an 11 month old baby, in the back of her mother's car. stolen from the family home. tonight the baby is safe and the search continues for the suspect.

in san francisco. supporting same-sex marriage. on the night before proposition 8. take the spotlight in front of the u.s. supreme court. this is video from our helicopter partnership with a-b-c 7 news. kron 4's dan kerman shows us the optimism here in the bay area. that has some people believing the supreme court's ultimate decision on california's ban on same sex marriage. will be historic and in their favor. >> reporter: supporters of very cheap quality took to the street >> things are changing in this country. >> my partner and i want to get married in october of. >> some of those are already married before proposition . however, we were not recognized from the government. they are

>> coming up on to another big story. an 11-month old girl, taken in the back seat of a stolen car, is safe tonight. the amber alert cancelled. police discovered baby gabriela hours later in the abandoned s-u-v. tonight -- the suspect is still on the loose. kron 4's j-r stone spoke with the police officer who found the baby. police say, the girl's mother, graciella, noticed a woman who she thought was suspicious. near her car shortly before it was stolen. she described the woman as white or hispanic and in her 30s, wearing a dark top and dark pants.

>> this officer abroad with the child to the hospital and then was reunited. >> she was crying but then she was very excited to see her mother. she was very emotional it was a bit traumatic for her. >> police say the woman was a thought that she was suspicious before it was stolen. she described her as in the 30's white or hispanic. now let's take a look how it all unfolded. at 6:40 this morning, a white jeep liberty was stolen from the driveway of graciella quintero -- with her baby, gabriella inside. quintero says, she stepped away from her car momentarily -- and when she returned, it was gone. at 11:22 a-m officers found the stolen jeep at an apartment complex. near the

seven trees community center. with the baby still in the backseat. the baby appeared to be in good health but was taken to a hospital as a precaution. a short time later-- at 12:30 this afternoon-- the baby and her mother, were reunited at the hospital. this is video from our helicopter partnership with abc 7 news showing officers taking the baby inside the hospital. new at 11. san francisco police made an arrest today. in the 2010 golden gate park murder investigation of michael ponder. daniel hill, of reno, has been arrested in connection with the murder of ponder-- who was stabbed to death. ponder's body was found in golden gate park, by an officer who was patrolling the area. detectives developed information that linked hill to the murder. after he was arrested for an unrelated murder investigation in reno. hill is currently being held in reno on that local murder charge. >> santa clara's second gun buyback event on saturday. brought in more than 600 fire arms. the event-- held by santa clara county -- paid out a

total of 61-thousand- dollars. in exchange for 610 firearms. the guns collected included. 17 assault weapons, 225 handguns, 237 rifles, 123 shotguns and eight other weapons -- such as b-b guns-- which did not receive pay outs. the buyback event also included a peace walk. and a resource fair, where 150 gang- related items were collected. (cheering) along the pacific coast near pacifica, there was an official ribbon cutting for two new tunnels that will provide a bypass along highway - one at devil's slide. the area has been plagued for years by rockslides. and a harrowing passage through a narrow stretch of roadway. the tunnels are set to open

to the public early tuesday morning. the total cost of the project was 439- million dollars. as cal-trans makes the transition to open the tunnel. officials say, commuters should expect big delays. this wednesday -- toll takers will be gone for good from the golden gate bridge. and all- electronic tolling will be in place. officials plan to begin the conversion by midnight this wednesday. if you have fastrak, you

>> jacqueline: we are seeing some local rainfall returns but not quite as much of a chance hitting the ground but later this week. we could see cloud cover partly to mostly cloudy and manage a slight chance of sprinkles. will talk more about that and the rainfall, coming up. >> people continued to line up outside the u.s. supreme court. bart will be partially closing the transbay tube. three nights per week. for the next 14 -months. it is part of the ongoing work to make the light rail system more earthquake safe. from 10pm to about 4am every tuesday, wednesday and thursday evening for the next 14 months, bart will limit train travel through the tube to just one track. that means that evening riders are going to experience a delay of somewhere between 15 and 20 minutes starting around 10pm on those three nights for the next 14 months.

during that time, work crews will move in with this specialized truck. and begin installing 4- ton steel plates inside the tube. to make it stronger. the price tag for bart's entire seismic retro fit project, including the tube work, is 1-point- 2 billion dollars. most of the funding comes from bond measure a-a, which was approved by voters in 2004. coming up. people continue to line up outside the u.s. supreme court. despite the snow and freezing temperatures. hoping to hear the prop 8 arguments tomorrow. plus -- a service dog. stolen on a bart train. is back home with its owner tonight. sports with gary

archie. the service dog that was stolen from his owner. is now back home. the owners received an anonymous tip of archie's location. san francisco police acted on the tip and found archie near the powell street bart station. archie's owner --kerrin lanahan -- could not be happier. >> and i freaked out and i went to the police it had been a living nightmare. i was so happy that i was able to get them. >> the owner of a tucson gun store where former u-s representative gabrielle giffords' husband purchased a semi-automatic rifle has canceled the transaction. the owner says a full refund was sent to mark kelly because the former astronaut didn't plan to keep the ar-15-style rifle for his personal use. kelly bought the gun saying he wanted to show how easy it is to buy an assault weapon. he planned to turn it into police. his wife was among 13 people hurt in a shooting outside a tucson supermarket that left six others dead back in 2011. and in the nations capital tonight. people continue to line up outside the u.s. supreme court despite the snow and freezing temperatures they're hoping for seats to

hear the historic arguments on prop 8 and the defense of marriage act. they have been camped out for days. and they're not about to budge. reporter joe johns has more. they're waiting to witness history. >> "as a gay american i think its very important to be a part of history." scores of people standing in line since last thursday dealing with snow from sunday to monday all in hopes of grabbing one of 250 seats available for the general public, when the supreme court takes up same-sex marriage this week. >> "it takes dedication to be out here." also expected in the audience on wednesday as a guest of the court, jean podrasky of san francisco and her partner. podrasky is a lesbian

cousin. of chief justice john roberts. in a statement, she said, quote: "i feel confident that john is wise enough to see that society is becoming more accepting of the humanity of same-sex couples and the simple truth that we deserve to be treated with dignity, respect, and equality under the law." how much roberts' personal relationships might affect his decision on same-sex marriage is an open question. paul smith has some insight he's an openly gay attorney who argued one of the landmark cases involving gay rights striking down laws banning sexual relations between same sex couples. before that, he was also a clerk for justice lewis powell. >> "i think it has some impact on people to know family members and friends who are out and gay and happy and functioning in society. on the other hand its not by any means going to be a good predictor." we'll find out starting tuesday, when the court hears the challenge to proposition 8 -- california's same-sex marriage ban. that challenge is brought by california couples including jeff zarillo and paul katami.who say they have a right to marry just
